Legal Requirements

  • A written service or employment contract is mandatory
    • IP must be explicitly transferred to the hiring company
    • Contractor relationships cannot fully resemble employment (to avoid misclassification)

Tax and Payroll Compliance

  • Contractors (PE)
    Contractors pay their own taxes: a fixed monthly social contribution + 6% income tax and military tax.
    Foreign companies have no Ukrainian tax obligations.
  • EOR model
    The EOR calculates and pays all Ukrainian employment taxes.
  • Local entity
    A company with a Ukrainian presence becomes responsible for payroll taxes and reporting. Diia City significantly reduces the tax burden for IT companies.
